The State of Alabama requires private cemeteries to maintain a perpetual care fund, which is managed by a third party and audited each year by the Alabama Board of Funeral Services.
The cemetery cannot use the principal in this fund. It remains in place to keep the property cared for regardless of future ownership or management.
